Terms of Service

1. Acceptance of Terms

By downloading, installing, or using NutriMind ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified Terms.

2. Description of Service

NutriMind is a nutrition tracking application that uses artificial intelligence to help users log food, track calories and macronutrients, and generate meal plans. The App is provided "as is" and "as available."

2.1 Key Features

• AI Food Scanning: Photograph meals to get nutritional estimates
• Voice Input: Speech-to-text for hands-free meal logging
• Barcode Scanning: Scan packaged foods with product history for quick re-logging
• Meal Plan Generation: AI-powered personalized meal plans
• Recipe Saving: Save favorite meals as recipes for quick re-logging
• Macro Coach: AI assistant for nutrition guidance and questions
• Smart Suggestions: Personalized meal recommendations based on your habits
• Progress Tracking: Weight history, streaks, and achievement badges
• Weekly Challenges: Goal-based challenges to keep you motivated
• Friends & Social: Connect with friends, share achievements, and stay accountable
• Progress Photos: Local-only photo tracking for your transformation
• Dark Mode: Comfortable viewing in any lighting condition
• Home Screen Widget: Quick view of daily progress (iOS & Android)
• Health Platform Sync: Optional sync with Apple Health (iOS) or Google Health Connect (Android)

4. User Accounts

4.1 Account Creation & Age Requirement

You must be at least 17 years of age to create an account and use NutriMind. By creating an account, you represent and warrant that you are 17 or older. You agree to provide accurate information and keep your account credentials secure.

We verify age during registration. If we believe you are under 17, we may terminate your account.

NutriMind does not accept parental consent for users under 17 due to the nature of our social and messaging features.

4.2 Account Responsibility

You are responsible for all activity under your account. Notify us immediately if you suspect unauthorized access to your account at security@getnutrimind.com.

4.3 Account Termination

We may suspend or terminate your account if you violate these Terms, engage in harmful behavior, or abuse the Service. You may delete your account at any time through Settings > Data > Delete Account.

5. Subscriptions & Billing

5.1 Free Tier

The free tier provides basic features with the following limitations:

• Limited AI food scans per day
• Limited meal plan generations
• Limited Macro Coach messages
• Advertisements displayed

5.2 Premium Subscription

NutriMind Premium is available as:

5.4 Billing and Renewal

• Subscriptions are billed in advance on a recurring basis
• Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
• Payment is charged to your App Store or Google Play account
• Prices may change with notice; existing subscriptions honor the original price until renewal

5.5 Cancellation

• Cancel your subscription at any time through your App Store or Google Play settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods
• After cancellation, you retain premium access until the end of your paid period, then revert to the free tier

5.6 Refunds

Refund requests are handled by Apple App Store or Google Play Store according to their respective refund policies. We do not process refunds directly.

6. Referral Program

NutriMind offers a referral program where you can earn premium days by inviting friends:

6.1 How It Works

• Share your unique referral code with friends
• When they sign up and log food for 3 consecutive days, you both earn 7 days of premium
• Maximum of 30 days of premium can be earned through referrals

6.2 Referral Rules

• Each referral code can only be used once per new user
• Creating fake accounts to abuse the referral system is prohibited
• We reserve the right to revoke rewards obtained through abuse
• Referral rewards are non-transferable and have no cash value

7. Social Features

NutriMind includes optional social features to help you stay motivated and accountable:

7.1 Friends & Connections

• Connect with friends using friend codes or usernames
• View friends' achievements, streaks, and activity (based on their privacy settings)
• Designate accountability partners for closer progress sharing, including the ability to view each other's daily food logs when permitted
• Send encouragement check-ins to accountability partners

7.2 Community Guidelines

When using social features, you agree to:

• Treat other users with respect
• Not harass, bully, or send unwanted messages
• Not share inappropriate or offensive content
• Not impersonate other users
• Not send spam, unsolicited promotions, or chain messages
• Not use messaging for commercial solicitation or advertising
• Not send content promoting self-harm, eating disorders, or dangerous practices
• Not request or share personal contact information through messages
• Use messaging for its intended purpose: encouragement, motivation, and accountability
• Report any concerning behavior to support@getnutrimind.com

7.3 Privacy & Blocking

• You control what information friends can see through Social Privacy settings
• You can remove friends or block users at any time
• Blocked users cannot send you friend requests or view your activity
• We may suspend social features for users who violate community guidelines

7.4 Weekly Challenges

• Challenges are optional goals to help motivate your nutrition journey
• Challenge completion is tracked automatically based on your logged data
• Challenge results may be shared with friends (based on your privacy settings)
• We reserve the right to modify or discontinue challenges at any time

7.6 Direct Messaging

NutriMind includes an inbox messaging feature for sending encouragement to friends:

• The messaging feature is for positive encouragement, motivation, and accountability support
• You may only message mutual friends. You cannot message users who have blocked you
• Messages are automatically deleted after 90 days. You may delete messages at any time
• We do not guarantee message delivery or storage. Messages may be delayed or lost
• Blocking a user hides existing message threads. Unblocking does not restore hidden messages

7.7 Content Moderation & Reporting

• We use reactive moderation based on user reports. We do not proactively scan messages
• Report messages violating guidelines via the report button. Reports reviewed within 48 hours
• When reported, we may review message content and history to assess violations
• Violations may result in: warning, messaging suspension, permanent ban, or account termination
• Appeal moderation decisions by emailing support@getnutrimind.com within 14 days
• Submitting false reports may result in action against your account
• We may disclose messages to law enforcement if required by law or to prevent harm

8. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or hack the App
• Interfere with the App's operation or servers
• Upload malicious content or attempt to exploit vulnerabilities
• Create multiple accounts to abuse free tier limits or referral rewards
• Use automation, bots, or scripts to interact with the App
• Share your account credentials with others
• Use the App to harm yourself or others
• Misuse the AI features (e.g., scanning inappropriate content)
• Circumvent rate limits or usage restrictions
• Use messaging to harass, stalk, or send threatening messages
• Send bulk, automated, or repetitive messages
• Create accounts to evade messaging restrictions or blocks
• Solicit users to communicate externally to evade guidelines

9. Intellectual Property

9.1 Our Rights

NutriMind, including its design, features, code, branding, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without written permission.

9.2 Your Content

You retain ownership of content you create (food logs, meal plans, progress photos, etc.). By using the App, you grant us a limited, non-exclusive license to store and process your content solely to provide the Service.

9.3 Feedback

If you provide feedback, suggestions, or bug reports, you grant us the right to use this information to improve the App without any obligation to you.

10. Third-Party Services

The App integrates with third-party services including:

• Google Gemini AI: For food analysis and meal planning
• Supabase: For data storage and authentication
• RevenueCat: For subscription management
• Google AdMob: For advertisements (free users)
• Firebase: For analytics and push notifications
• Sentry: For crash reporting and performance monitoring
• Apple HealthKit: For health data sync on iOS (optional)
• Google Health Connect: For health data sync on Android (optional)

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service availability or performance.

10.1 Apple HealthKit & Google Health Connect

If you enable Health Sync:

• NutriMind reads steps, active calories, distance, workouts, heart rate, and weight from your device's health platform
• NutriMind writes nutrition and hydration data to your health platform
• This integration is governed by Apple's and Google's respective terms
• We do not access your health data beyond the specific types you authorize
• Health data is processed locally on your device
• You can revoke access at any time through device settings or NutriMind settings

11. AI-Generated Content

NutriMind uses AI to analyze food images, generate meal plans, and provide coaching. You acknowledge that:

• AI nutritional estimates are approximations, not exact values
• AI may sometimes produce inaccurate or unexpected results
• AI-generated meal plans are suggestions, not prescriptions
• Macro Coach provides general guidance, not professional medical advice
• You are responsible for verifying information that affects your health
• We continuously improve AI accuracy but cannot guarantee perfection

12. Limitation of Liability

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

• Your use of the App
• Violation of these Terms
• Infringement of any third-party rights
• Any content you submit to the App

14. Dispute Resolution

14.1 Informal Resolution

Before filing any legal claim, you agree to contact us at legal@getnutrimind.com to attempt informal resolution. We will work in good faith to resolve disputes within 30 days.

14.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.3 Venue

Any legal proceedings shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in these courts.

15. General Provisions

15.1 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

15.2 Entire Agreement

These Terms, together with our Privacy Policy and Cookies Policy, constitute the entire agreement between you and NutriMind.

15.3 Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce it in the future.

15.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to a successor in the event of a merger, acquisition, or sale of assets.
